U.S. Insurance Agent Compliance Checklist
This 8 checklist helps licensed insurance agents and producers follow the laws and ethical standards required in the United States. It includes state-level and federal rules you must know and follow.
1. Licensing & Certification
- Complete Pre-Licensing Education required by your state
- Pass the State Licensing Exam
- Complete Fingerprinting / Background Check
- Apply for a license through your State DOI or NIPR.com
- Renew your license before it expires
- Complete all Continuing Education (CE) credits on time
2. NAIC Model Law Compliance
- Follow the Unfair Trade Practices Act (no misleading sales)
- Comply with the Producer Licensing Act
- Protect customer data under privacy model rules
- Do not offer rebates or replace policies unethically
3. Sales & Marketing Practices
- Clearly state you are a licensed insurance agent
- Do not promise guaranteed income unless backed by contract
- Avoid fear tactics or misleading offers
- Get signed consent before contacting any lead
- Explain all product details: benefits, costs, and risks
- Keep notes of all client meetings and conversations
4. Client Data Protection & Privacy
- Only collect info needed to give a quote or application
- Use secure tools—no spreadsheets or personal devices
- Never share personal info without consent
- Post a Privacy Policy on all websites and forms
- Follow HIPAA if handling health/disability data
- Follow CCPA/CPRA rules for California residents
5. Communication & TCPA Rules
- Get written permission before calling or texting leads
- Use opt-in checkboxes on forms
- Do not call numbers on the Do-Not-Call list without consent
- Say who you are and why you’re calling each time
- Honor all opt-out and do-not-contact requests
6. Presentation & Sales Process
- Always start with a needs analysis
- Offer multiple policy options when possible
- Use simple, respectful language when presenting
- Give the client brochures or key info documents
- Get all forms signed before submitting applications
- Let the client ask questions and take their time
7. Recordkeeping & Reporting
- Keep records for 5–7 years (applications, notes, emails)
- Maintain signed documents and communication logs
- Report any suspected fraud or misconduct to the DOI
- Keep your licensing and appointments up to date
8. Professional Conduct
- Always act in the best interest of your client
- Avoid conflicts of interest or hidden incentives
- Be honest about your experience and licenses
- Never forge signatures or mislead clients
- Stay updated with product changes and new laws
